These Terms and Conditions (the "Terms") govern your access to and use of our Site, services, and the purchase of all electronic nicotine delivery systems (ENDS), disposable vapes, e-liquids, hardware, and related accessories (collectively, "Products").

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to all terms and conditions, you must not access the Site or purchase any Products.

1. Mandatory Minimum Age Requirement (21+)

  • Legal Age Threshold: You must be at least 21 years of age (or the minimum legal smoking/vaping age in your jurisdiction, whichever is older) to browse the Site, create an account, or purchase Products.

  • Age Verification: Every order is subject to mandatory age and identity verification using automated third-party verification software. You agree to provide accurate, current, and complete legal information (including full legal name, date of birth, residential address, and government-issued identification if requested).

  • Falsification Penalties: Misrepresenting your age, using fraudulent identification, or attempting to purchase Products on behalf of a minor is strictly prohibited, constitutes fraud, and will result in immediate order cancellation, account termination, and potential reporting to local law enforcement authorities.

2. Product Compliance & Nicotine Warnings

WARNING: The products sold on this Site contain nicotine, an addictive chemical. Products are intended exclusively for adult consumers of legal purchasing age. Keep out of reach of children and pets.

  • Health Disclaimer: Products sold by Cursed Industry have not been evaluated by the U.S. Food and Drug Administration (FDA) to treat, cure, or prevent any disease, nor are they marketed as smoking cessation devices. Consult a physician before use if you are pregnant, nursing, have cardiovascular issues, high blood pressure, or diabetes.

  • Lithium-Ion Battery Safety: You acknowledge that electronic vapor devices and disposable vapes contain lithium-ion batteries. You assume full responsibility for the proper handling, storage, charging, and disposal of batteries in accordance with manufacturer guidelines. Cursed Industry is not liable for damages resulting from battery misuse, overcharging, physical modification, or improper storage.

3. Shipping, Delivery & Legal Restrictions

  • PACT Act Compliance: We operate in full compliance with the Prevent All Cigarette Trafficking (PACT) Act and all applicable federal, state, and local laws governing the interstate shipment of vapor products.

  • Delivery & Adult Signature Required: Where required by law, packages containing vapor products will be shipped via authorized carrier networks and require an Adult Signature (21+) with valid government-issued photo ID upon delivery.

  • Restricted Jurisdictions: We do not ship to jurisdictions where the sale, shipment, or possession of flavored vapor products, disposable vapes, or e-liquids is prohibited by state, municipal, or local law. Any orders placed for delivery to restricted areas will be automatically cancelled and refunded minus applicable processing fees.

  • No P.O. Boxes / Military Bases: We cannot ship vapor products to standard P.O. Boxes, APO/FPO/DPO addresses, or international forwarding addresses.

4. Orders, Pricing & Cancellations

  • Order Acceptance: Your receipt of an electronic order confirmation does not signify our final acceptance of your order. We reserve the right to accept, decline, or limit order quantities for any reason, including failure to pass age verification, pricing errors, or suspicion of reseller/unauthorized distribution.

  • Pricing & Taxes: All prices are displayed in USD and are subject to change without notice. Applicable state, local, excise, and wholesale tobacco/vapor taxes will be automatically calculated and applied at checkout based on the shipping address.

  • Order Modifications & Cancellations: Due to fast processing times, once an order passes verification and enters fulfillment, modifications or cancellations cannot be guaranteed.

5. Returns, Replacements & Warranty Disclaimer

  • Hygiene & Consumables Policy: Due to the nature of vapor products, hygiene regulations, and health safety standards, all sales of disposable vapes, opened e-liquids, coils, and drip tips are FINAL.

  • Defective on Arrival (DOA): If you receive a product that is non-functional straight out of the packaging (Dead on Arrival), you must report the issue to cs@cursedindustry.com within 48 hours of delivery. Claims require clear photographic or video proof of the defect, serial numbers, and original packaging.

  • Third-Party Warranties: Manufacturer warranties (if applicable) must be pursued directly through the product manufacturer unless otherwise specified.

6. Prohibited Activities

You agree not to use the Site to:

  • Purchase Products for redistribution, wholesale resale, or transfer to individuals under the age of 21.

  • Bypass, disable, or tamper with age verification gateways, security features, or regional checkout filters.

  • Scrape, crawl, harvest data, or place automated bot orders.

  • Introduce malicious code, trojans, viruses, or disruptive technical exploits.

7. Intellectual Property

All content, logos, custom graphics, text, product descriptions, images, and software on this Site are the property of Cursed Industry or its respective brand licensors and are protected under United States and international copyright, trademark, and intellectual property laws. Unauthorized reproduction, modification, or commercial use is strictly prohibited.

8. Limitation of Liability & Indemnification

  • As-Is Basis: All Products and Site features are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.

  • Liability Cap: To the fullest extent permitted by law, Cursed Industry, its officers, employees, and suppliers shall not be liable for any indirect, incidental, punitive, special, or consequential damages resulting from the use or misuse of our Products, delivery delays, or inability to access the Site. In no event shall our total liability exceed the purchase price of the specific product in dispute.

  • Indemnification: You agree to indemnify, defend, and hold harmless Cursed Industry against any claims, losses, liabilities, fines, and legal fees resulting from your violation of these Terms, non-compliance with age requirements, or unauthorized use of Products.

9. Dispute Resolution & Governing Law

  • Governing Law: These Terms and any related transactions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

  • Binding Arbitration & Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the purchase of Products shall be resolved through binding individual arbitration rather than in court, and you expressly waive your right to initiate or participate in any class action, collective proceeding, or representative lawsuit.

10. Modifications to Terms

We reserve the right to amend, update, or replace any part of these Terms at our sole discretion. Any changes are effective immediately upon posting to the Site. Your continued use of the Site following the posting of modifications constitutes acceptance of those changes.
